Terms and Conditions for Aloha Golf Card, LLC
These Terms & Conditions contain important information about becoming an Aloha Golf Card Holder ("Member"), including your rights and responsibilities.
- Your purchase or use of the Aloha Golf Card constitutes acceptance of and agreement to abide by the following Terms and Conditions.
- The Aloha Golf Card, LLC ("Company") is an independent company and has no ownership interest in any Participating Golf Courses or Participating Service Providers.
- Aloha Golf Card Members do not have any ownership interest in Aloha Golf Card, LLC ("Company") or any of the Participating Golf Courses and Participating Service Providers.
- Aloha Golf Cards are available to individuals eighteen (18) years of age or older. Each applicant for an Aloha Golf Card must complete an application online (www.alohagolfcard.com) and submit the application to the Company along with the payment of the then current Aloha Golf Card fee. The Company reserves the right to deny the application and not process the payment of the card fee.
- The Aloha Golf Card will not become effective unless and until the Company: (a) executes the Application; and (b) receives the applicant's card fee and applicable state sales tax. Upon receipt of the fee the applicant's membership is activated and the new Member shall be issued an Aloha Golf Card.
- When ordering the Aloha Golf Card online (www.alohagolfcard.com) the applicant has the opportunity to review these Terms & Conditions. A legally binding contract between the applicant, who is now a Member, and the Company is created at the point of acceptance of the applicant's order when the Company executes the application. The Company reserves the right to choose not to accept an applicant's order for any reason, at its discretion, and will not be liable to the applicant or anyone else in those circumstances.
- Each Aloha Golf Card Member is issued an Aloha Golf Card. Included on the card is the Member's name, membership number and expiration date. An Aloha Golf Card may not be used by any person other than the person to whom it is issued. The Company reserves the right to suspend or revoke card privileges for any unauthorized and/or improper use or transfer to a third party of an Aloha Golf Card. Each Member must present his/her Aloha Golf Card and Photo Identification (Driver's License or Passport) at Participating Golf Courses and Participating Service Providers in order to receive and use any benefits, discounts or privileges. Failure to present the Aloha Golf Card to the Participating Golf Course or Participating Service Provider may result in refusal to honor card benefits.
- The Aloha Golf Card is not transferable to any third party nor is it replaceable if lost, misplaced or stolen. The Company is not responsible for loss, theft, or mutilation of the card. The Aloha Golf Card cannot be redeemed for cash.
- When properly authorized, the Aloha Golf Card may be used to receive, subject to availability, certain access and privileges, at Participating Golf Courses and Participating Service Providers. Some restrictions may apply at Participating Golf Courses and with Participating Service Providers. Check with either Aloha Golf Card Member Services or the Participating Golf Course or Participating Service Provider for any restrictions that may apply.
- Green fee rates and the roster of Participating Golf Courses listed on www.alohagolfcard.com are subject to change. Aloha Golf Card Company does not provide any guarantees the green fee rates and food and beverage and golf shop retail discounts for Aloha Golf Card Members at the Participating Golf Courses are the lowest rates and discounts the golf courses offer as from time to time golf courses will run specials lower than the promoted Aloha Golf Card rates.
- Neither the Company nor any Participating Golf Course or Participating Service Provider will be responsible for tee times or reservations booked at non-participating golf courses or with non-participating service providers.
- The Aloha Golf Card is subject to an expiration date. After the expiration of the card term, a Member may have the opportunity to renew the card for an additional term subject, to the payment of the then current renewal card fee and any revised and updated Terms and Conditions that may apply to the use of the Aloha Golf Card.
- Members may book their tee time at all Participating Golf Courses by calling the courses' golf shop staff directly. Additionally, Members may book their tee time at most Participating Golf Courses by using www.alohagolfcard.com. Please refer to www.alohagolfcard.com as some of the Participating Golf Courses may not be connected to the Aloha Golf Card network for tee time booking. A transaction fee per tee time booking is applicable when booking tee times online and are payable by major credit card. When making a tee time reservation by calling a Participating Golf Course directly Members must inform the golf shop staff that they are Aloha Golf Card Members. It is advised that Members arrive at the Participating Golf Course at least thirty (30) minutes (or as directed by the Participating Golf Course) in advance of their tee time. It is a Member's responsibility to make sure he/she is aware of the Participating Golf Course's local rules and policies before making his/her tee time reservation. Payment of the green fee is made at the time of check-in at the Participating Courses' golf shops. Green fee is subject to applicable State Sales Tax. In the event a Participating Golf Course is unavailable due to weather, maintenance, a group booking or a tournament, the golf shop staff will inform the Member upon his or her tee time request and the Member can choose another day or alternate Participating Golf Course.
- Replay rounds may be booked at the conclusion (or in accordance with the Participating Golf Courses' rules) of a Member's first golf round upon Participating Golf Course availability. Members must inquire with the golf shop staff as to availability of a replay round and rate.
- The cancellation policies for the Participating Golf Courses vary. In general, tee time reservations must be cancelled no later than 24 hours prior to day of play and is the responsibility of the Member, not Aloha Golf Card Company. To cancel a golf tee time at a Participating Golf Course, a Member must contact the Participating Golf Course directly if he or she had made the tee time reservation by calling the course directly. If the Member made the tee time reservation on line through www.alohagolfcard.com then the Member must cancel the reservation prior to the cancellation deadline by returning to www.alohagolfcard.com and following cancellation procedures. After the cancellation deadline, the Member must call the Participating Golf Course directly. A Member could be charged for a no-show or cancellation beyond a Participating Golf Course's cancellation deadline.
- All Aloha Golf Card Members and their guests are expected to abide by the rules, regulations, and restrictions in effect at Participating Golf Courses and Participating Service Providers (such as, check-in and check-out procedures, cancellation procedures, smoking and no-smoking restrictions, and dress codes).
- No Member or their guests shall engage in conduct which is disruptive, abusive or violent, or which interferes with the enjoyment of the Participating Golf Courses and Participating Service Providers by other users. Any Member or guest whose conduct is deemed by the Company, in its sole judgment, to be improper or likely to endanger the safety, harmony or good reputation of the Company, Participating Golf Courses and Participating Service Providers or of its members, guests, or staff may be reprimanded, suspended or expelled from Aloha Golf Card benefits and usage. If such Member or guest is suspended or expelled, the Member shall not be entitled to the refund of any of the card fee.
- The Company may terminate a card without cause at any time by advising the Member and returning a prorated share of the Member's card fee. The Company reserves the right to terminate any card privileges for cause in the event a Member or its guests refuses or fails to abide by any of these Terms & Conditions. In the event, the Company terminates a card for cause, the offending Member shall not be entitled to any return or refund of card fee.
- Each Aloha Golf Card Member shall be responsible for notifying the Company of any change in member information (including but not limited to mailing address and email address). The Company will not be responsible for the failure of a Member to receive changes in Member Benefits or the Participating Golf Courses' and Participating Service Providers' policies or practices due to the failure to comply with this provision.
- Neither the Company nor any Participating Golf Course or Participating Service Provider makes any warranties or representations of any kind regarding the scope and nature of any services you may receive with the use of the Aloha Golf Card.
- Neither the Company nor Participating Golf Course or Participating Service Provider assume any responsibility and shall not be liable for any injury, loss, claim, cost, damage, or any special, exemplary, punitive, indirect, incidental, or consequential damages of any kind, whether based in contract, tort, strict liability, or otherwise which arises out of or is in any way connected with (i) your use of the Aloha Golf Card or (ii) the performance or non-performance of any third party providers even if you have been advised of the possibility of damages. The Company or any Participating Golf Courses and Participating Service Providers shall not be liable for any delay or failure of performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control.
- The Terms and Conditions contained in this document and the application for Aloha Golf Card Membership, together constitute the entire agreement between the Company and the purchaser and user of the Aloha Golf Card. These Terms and Conditions shall be governed and interpreted in accordance with the laws of the State of California. The exclusive jurisdiction for any claim, dispute, or litigation ("Litigation") arising out of these Terms and Conditions including the purchase and use of the Aloha Golf Card sold by the Company shall be vested in the federal and state courts located in Riverside County, California and such courts shall have the sole and exclusive jurisdiction over the Parties and the subject matter of any such Litigation. The purchaser and user of any Aloha Golf Card sold by the Company hereby agrees to consent to, and waives all arguments or claims regarding venue for any such Litigation. Further, the purchaser and user agrees that if the Company prevails in such Litigation it shall be entitled to collect from the purchaser and user all costs incurred by it in the Litigation including reasonable attorneys' fees plus court costs.
- Lack of use of the Aloha Golf Card and its associated benefits, discounts or privileges does not constitute a refund of the card purchase fee.
